Petition for enjoyment of spouse's separate estate, when.

452.170. If any married person shall hold real estate in his or herown right, and his or her spouse, by criminal conduct toward him or her, orby ill usage, shall give him or her cause to live separate and apart fromhim or her, such person may petition the circuit court, setting forth suchfacts, and therein pray that such estate may be enjoyed by him or her forhis or her sole use and benefit.
