454.060. 1. Before making the demand on the governor of anyother state for the surrender of a person charged in this statewith the crime of failing to provide for the support of anyperson, the governor of this state may require any prosecutingattorney of this state to satisfy him that at least sixty daysprior thereto the obligee brought an action for the support undersections 454.010 to 454.360, or that the bringing of an actionwould be of no avail.

2. When under this or a substantially similar law, a demandis made upon the governor of this state by the governor ofanother state for the surrender of a person charged in the otherstate with the crime of failing to provide support, the governormay call upon any prosecuting attorney to investigate or assistin investigating the demand, and to report to him whether anyaction for support has been brought under sections 454.010 to454.360 or would be effective.

3. If an action for the support would be effective and noaction has been brought, the governor may delay honoring thedemand for a reasonable time to permit prosecution of an actionfor support.

4. If an action for support has been brought and the persondemanded has prevailed in that action, the governor may declineto honor the demand.

5. If an action for support has been brought and pursuantthereto the person demanded is subject to a support order, thegovernor may decline to honor the demand so long as the persondemanded is complying with the support order.
