454.420. Any legal action necessary to establish or enforcesupport obligations owed to the state shall be brought byprosecuting attorneys, or other attorneys under cooperativeagreement with the division of child support enforcement, uponbeing furnished notice by the division of such obligation. Ifthe amount of the support obligation owed to the state has notbeen determined because no court order exists, the division ofchild support enforcement may refer the case to the appropriateprosecuting attorney, or other attorney under cooperativeagreement with the division, for establishment and enforcement ofa support order or order for reimbursement. When a recipient isno longer eligible for aid to families with dependent childrenbenefits, the assignment shall terminate, unless the recipientand the division of child support enforcement agree otherwise,except for those unpaid support obligations still owing to thestate under the assignment at the time of the discontinuance ofaid. Upon referral from the division of child supportenforcement, such unpaid obligations shall be collected by theprosecuting attorney, or other attorney under cooperativeagreement with the division, up to the amount of unreimbursed aidpaid by the division of family services prior to or afterexecution of the assignment of support rights. Moneys collectedpursuant to this section shall be paid to the department ofsocial services for deposit in the child support enforcement fundin the state treasury.
