Domestic violence intervention/rehabilitation pilot projects--purpose,funding, rules.

455.305. 1. Beginning in 2001, the department of social services andthe Missouri domestic violence commission established pursuant to thischapter, shall establish and administer up to twenty domestic violenceintervention/rehabilitation pilot projects. Such projects shall operate assatellite projects through existing domestic violence prevention facilitieswhere no such facilities exist for the following purposes:

(1) To implement, expand, and establish cooperative efforts betweenlaw enforcement officers, prosecutors, victim advocacy groups, and otherrelated parties to investigate and prosecute incidents of domesticviolence;

(2) To prevent domestic violence and provide immediate shelter forvictims of domestic violence;

(3) To provide treatment and counseling to victims of domesticviolence; and

(4) To work in cooperation with the community to develop educationand prevention strategies regarding domestic violence.

2. Funding for the pilot programs shall be subject to appropriation.

3. The department and the commission shall promulgate rules andregulations, pursuant to chapter 536, RSMo, to implement, administer, andmonitor the pilot projects. Any rule or portion of a rule, as that term isdefined in section 536.010, RSMo, that is created under the authoritydelegated in this section shall become effective only if it complies withand is subject to all of the provisions of chapter 536, RSMo, and ifapplicable, section 536.028, RSMo. This section and chapter 536, RSMo, arenonseverable and if any of the powers vested with the general assemblypursuant to chapter 536, RSMo, to review, to dely the effective date or todisapprove and annul a rule are subsequently held unconstitutional, thenthe grant of rulemaking authority and any rule proposed or adopted afterAugust 28, 2000, shall be invalid and void.

4. Beginning in 2001, the department and the commission shall submitan annual report of its activities to the speaker of the house ofrepresentatives, the president pro tem of the senate, and the governorbefore December thirty-first of each year.
