456.1-109. 1. Notice to a person under sections 456.1-101 to456.11-1106 or the sending of a document to a person under sections 456.1-101to 456.11-1106 must be accomplished in a manner reasonably suitable under thecircumstances and likely to result in receipt of the notice or document.Permissible methods of notice or for sending a document include first-classmail, personal delivery, delivery to the person's last known place ofresidence or place of business, or a properly directed electronic message.
2. Notice otherwise required under sections 456.1-101 to 456.11-1106 ora document otherwise required to be sent under sections 456.1-101 to456.11-1106 need not be provided to a person whose identity or location isunknown to and not reasonably ascertainable by the trustee.
3. Notice under sections 456.1-101 to 456.11-1106 or the sending of adocument under sections 456.1-101 to 456.11-1106 may be waived by the personto be notified or sent the document.
4. Notice of a judicial proceeding must be given as provided in theapplicable rules of civil procedure.
