Issues shall be made up and tried, when.

470.110. If any person shall appear and deny the title setup by the state, or traverse any material fact in the informationalleged, issues shall be made up and tried as other issues offact, and a survey may be ordered and entered as in other actionswhen the title or boundaries of land are in dispute.
