472.040. In all suits and other proceedings in the probatedivision of the circuit court, the party prevailing shall recoverhis costs against the other party, except in those cases in whicha different provision is made by law. Whenever costs are givenagainst executors and administrators, the estate shall pay thecosts. Parties presenting claims against estates, for the samecauses and in the same manner, may be ruled to give security forcosts, as is provided in practice in civil cases.
