One-time retirement plan election for certain judges.

476.517. Any judge who is or has been a commissioner or deputycommissioner of the circuit court appointed after February 29, 1972, whohas received creditable service pursuant to chapter 104, RSMo, and sections476.515 to 476.565, based on service as a commissioner or deputycommissioner shall make a one-time retirement plan election uponapplication to receive retirement benefits. Such judge shall elect to:

(1) Receive retirement benefits based on all of the judge's serviceas a commissioner or deputy commissioner of the circuit court pursuant tosection 104.374 or 104.1024, RSMo, or sections 476.515 to 476.565; or

(2) Receive retirement benefits pursuant to section 104.374 or104.1024, RSMo, based on the judge's service as a commissioner or deputycommissioner of the circuit court prior to August 28, 1999, and receiveretirement benefits pursuant to sections 476.515 to 476.565 based on thejudge's service as a commissioner or deputy commissioner of the circuitcourt on or after August 28, 1999.
