Failure of clerk to transmit, or loss of record, proceedings.

508.240. If any clerk fail to transmit the transcript andpapers in any cause, the venue whereof has been changed, or ifthey be sent and lost, such loss or failure shall not operate asa discontinuance of such cause, but they may be filed at the nextterm of said court; or, if lost, copies of the original may befurnished and filed, and the cause shall proceed as if no suchfailure or loss had happened; provided, however, that the courtor the judge granting any change of venue shall have the power toset aside and annul the order thereof, by consent of parties, atany time before such transcript and papers shall be actuallyfiled in such other court.
