513.040. Any party entitled to an execution from a court ofrecord may have it directed as provided in section 513.035, or,at his option, he may have it directed to any sheriff in thestate of Missouri; and such execution may be levied, served andreturned by any sheriff in this state to whom it may be deliveredwithin the county of which he is sheriff, in like manner and withthe same effect as if it had been specially directed to him; butif no property, or not sufficient property to satisfy suchexecution, can be found in such county, the sheriff, at theoption of the plaintiff, may make thereon a return of hisproceedings and deliver it to the plaintiff, his agent orattorney, who may deliver the same to the sheriff of any othercounty in this state, who may levy, serve and return the same, asif it had been directed to him.
