Bond, by whom approved--attachment not to issue until.

521.080. The clerk shall judge of the sufficiency of thepenalty and the security in the bond; if they be approved, heshall endorse his approval thereon, and the same, together withthe affidavit and petition or other lawful statement of the causeof action, shall be filed before an attachment shall be issued;provided, that in all cases where the clerk shall be a party tothe suit, the sheriff shall pass on and determine the sufficiencyof the bond.
