521.400. When there are two or more defendants inattachment, and the property, effects or credits of part of themare attached by garnishment, and the others are not summoned, theplaintiff may, at his option, proceed against those whoseproperty, effects or credits have been attached, or continue thecause, and sue out new process against the other defendants; butwhen the property of one or more of the defendants has beenactually seized or secured by bond, the cause shall not bedelayed for the purpose of suing out new process against theother defendants, unless, for cause, the court so order.
