In case the lands sought to be appropriated areheld by any corporation, the right to appropriate the same by arailroad, telephone or telegraph company shall be limited to suchuse as shall not materially interfere with the uses to which, bylaw, the corporation holding the same is authorized to put saidlands. Where no agreement can be made between the parties, themode of assessing the damages provided heretofore, as to privatepersons, shall be adopted; and if the lands to be appropriatedlie in more than one county, an application may be made in anyone county in which any of the lands lie, and the damages shallbe assessed as to all the lands of the defendant corporationalong the whole line in one proceeding.
