Plaintiff--failure to prosecute his suit after obtainingproperty--value of property--assessment.

533.110. If the plaintiff fail to prosecute his action witheffect and without delay, and shall have the property in hispossession, and the defendant in his answer claims the same anddemands a return thereof, the court or a jury may assess thevalue of the property taken, and the damages for taking anddetaining the same for the time such property was taken ordetained from defendant until the day of the trial of the cause.
