Fellow servant defined.

537.190. All persons who are engaged in the common serviceof such railroad corporation, or of any person, company orcorporation operating a mine or mines, and who while so engaged,are working together at the same time and place, to a commonpurpose of same grade, neither of such persons being entrusted bysuch railroad corporation, person, company, or corporation withany superintendence or control over their fellow employees, arefellow servants with each other; except that nothing hereincontained shall be so construed as to make any agent or servantof any railroad corporation in the service of such railroadcorporation a fellow servant with any other agent or servant ofsuch railroad corporation engaged in any other department orservice of such corporation.
