Prosecution in wrong county--duty of court.

541.120. When it appears at any time before verdict orjudgment that the defendant is prosecuted in a county not havingjurisdiction of the offense, the court may order that all thepapers and proceedings be certified and transmitted to the propercourt of the proper county, and recognize the defendant to appearbefore such court on the first day of the next term thereof, toawait the action of the grand jury. The witnesses shall also berecognized to appear at such court, that the prosecution may beproceeded with as provided by law.
