550.180. Clerk liable for neglect, when.

Clerk liable for neglect, when.

550.180. If any clerk shall fail to tax the costs and makeout a proper fee bill, or shall willfully neglect to perform anyduty required of him in sections 550.140 and 550.190, he shall beliable to the person injured by such neglect in treble the amountof costs to which the party is entitled in the cause, and thecourt shall give judgment therefor against the clerk, on motionof the party entitled thereto; provided, that the party askingsuch judgment shall give two days' notice of such motion, whichmay be served on the clerk or his deputy.
