Probation may be granted, when.

559.120. The circuit court may place a defendant onprobation and require his participation in a program establishedpursuant to section 217.777, RSMo, if, having regard to thenature and circumstances of the offense and to the history andcharacter of the defendant, the court is of the opinion that:

(1) Traditional institutional confinement of the defendantis not necessary for the protection of the public, givenadequate supervision; and

(2) The defendant is in need of guidance, training or otherassistance which, in his case, can be effectively administeredthrough participation in a community-based treatment program.
