Cross burning prohibited, penalty--intent defined.

565.095. 1. It shall be unlawful for any person or persons with theintent to intimidate any person or group of persons to burn, or cause to beburned, a cross. Any person who shall violate any provision of thissection shall be guilty of a class A misdemeanor for a first offense and aclass D felony for a second or subsequent offense.

2. For purposes of this section, a person acts with the intent tointimidate when he or she intentionally places or attempts to place anotherperson in fear of physical injury or fear of damage to property.
