Office space and utilities services, how provided--retirement systemmembership.

600.040. 1. The city or county shall provide office spaceand utility services, other than telephone service, for thecircuit or regional public defender and his personnel. If thereis more than one county in a circuit or region, each county shallcontribute, on the basis of population, its pro rata share of thecosts of office space and utility services, other than telephoneservice. The state shall pay, within the limits of theappropriation therefor, all other expenses and costs of the statepublic defender system authorized under this chapter.

2. A complete budget for the state public defender systemshall be provided through an annual appropriation subject toapproval by the governor and the general assembly. The budgetrequest for the state public defender system shall be approved bythe commission and submitted directly to the governor and thegeneral assembly by the director and shall not be subject todiminution or alteration by the judicial department of stategovernment.

3. Any person who is a public defender or employee of apublic defender shall be entitled to all benefits of the Missouristate employees' retirement system as defined in sections 104.310to 104.550, RSMo.
