621.198. The administrative hearing commission shall publish and filewith the secretary of state rules of procedure for the conduct ofproceedings before it. Rules of procedure adopted pursuant to this sectionshall be designed to simplify the maintenance of actions and to enablereview to be sought, where appropriate, without the need to be representedby independent counsel. Any rule or portion of a rule, as that term isdefined in section 536.010, RSMo, that is created under the authoritydelegated in this section shall become effective only if it complies withand is subject to all of the provisions of chapter 536, RSMo, and, ifapplicable, section 536.028, RSMo. This section and chapter 536, RSMo, arenonseverable and if any of the powers vested with the general assemblypursuant to chapter 536, RSMo, to review, to delay the effective date or todisapprove and annul a rule are subsequently held unconstitutional, thenthe grant of rulemaking authority and any rule proposed or adopted afterAugust 28, 2001, shall be invalid and void.
