Liability for unlawful acts.

622.530. In case a common carrier shall do, cause to be done orpermit to be done any act, matter or thing prohibited, forbidden ordeclared to be unlawful, or shall omit to do any act, matter or thingrequired to be done by this chapter or by any order or decision of thedivision, such common carrier shall be liable to the persons orcorporations affected thereby for all loss, damage or injury caused therebyor resulting therefrom, and in case of recovery, if the court shall findthat such act or omission was willful, it may in its discretion fix areasonable counsel or attorney's fee, which fee shall be taxed andcollected as part of the costs in the case. An action to recover for suchloss, damage or injury may be brought in any court of competentjurisdiction by any such person or corporation.
