Rulemaking authority--disclosure of records, when.

630.975. 1. The director of the department of mental health shallpromulgate rules, guidelines and protocols for hospitals and physicians touse to help them to identify suspicious deaths of patients, residents, orclients in the care and custody of the department of mental health.

2. Any hospital, physician, medical professional, mental healthprofessional, or department of mental health facility shall disclose uponrequest all records, medical or social, of any client in the care andcustody of the department of mental health who has died to the mentalhealth fatality review panel established under section 630.925 toinvestigate the person's death. Any legally recognized privilegedcommunication, except that between attorney and client, shall not apply tosituations involving the death of a client in the care and custody of thedepartment of mental health.
