Burden of proof in matters heard by department, exceptions.

640.012. In all matters heard by the department of natural resourcesin this chapter and chapters 260, 278, 444, 643, and 644, RSMo, thehazardous waste management commission in chapter 260, RSMo, the state soiland water districts commission in chapter 278, RSMo, the land reclamationcommission in chapter 444, RSMo, the safe drinking water commission in thischapter, the air conservation commission in chapter 643, RSMo, and theclean water commission in chapter 644, RSMo, the burden of proof shall beupon the department of natural resources or the commission that issued thefinding, order, decision or assessment being appealed, except that inmatters involving the denial of a permit, license or registration, theburden of proof shall be on the applicant for such permit, license orregistration.
