Department of social services administrative trust fundcreated--disbursements--reports--lapse prohibited, exception.

660.012. 1. The treasurer of the state shall establish inthe state treasury a "Department of Social ServicesAdministrative Trust Fund" which shall be funded annually byappropriations and deposits thereto.

2. This fund shall contain moneys transferred or paid to thedepartment for goods and services provided by the department orits divisions to any governmental entity or to the public.

3. The commissioner of administration shall approvedisbursements from the fund at the request of the director of thedepartment or his designee in accordance with appropriations madetherefor.

4. The provisions of section 33.080, RSMo, notwithstanding,moneys in the fund shall not lapse, unless and then only to theextent to which the unencumbered balance at the close of anyfiscal year exceeds one-twelfth of the amount either appropriatedor paid or transferred to the fund during such fiscal year,whichever is greater.

5. The director of the department shall prepare an annualreport of all receipts and disbursements from the fund.
