Protection against spousal impoverishment and premature placement ininstitutional care, determination of eligibility for Medicaid andmedical assistance benefits.

660.690. In order to protect the community spouse of an individualliving in a residential care facility or assisted living facility, as definedin section 198.006, RSMo, from impoverishment and to prevent prematureplacement in a more expensive, more restrictive environment, the division offamily services shall comply with the provisions of subsection 6 of section208.010, RSMo, when determining the eligibility for benefits pursuant tosection 208.030, RSMo.
