48-2708. Retirement and employee welfare benefitplans.(1)A client and a professional employer organization shall each be deemed anemployer under the laws of this state for purposes of sponsoring retirementand employee welfare benefit plans for its covered employees.(2) A fullyinsured employee welfare benefit plan offered to the covered employees ofa single professional employer organization shall be for purposes of statelaw a single employee welfare benefit plan and shall not be considered a multipleemployer welfare arrangement, as defined in section 44-7603, and shall beexempt from the registration requirements of the Multiple Employer WelfareArrangement Act.(3) For purposes of the Small Employer Health Insurance AvailabilityAct, a professional employer organization shall be considered the employerof all of its covered employees and all covered employees of any client participatingin a health benefit plan sponsored by a single professional employer organizationshall be considered employees of the professional employer organization. Subjectto any eligibility requirements imposed by the plan or policy, the insurershall accept and insure all employees of the client and all beneficiariesof those employees.
