417.120  Appointment of Executive Director as guardian is appointment in capacity of office.

      1.  An appointment of the Executive Director as guardian is an appointment of the Executive Director in the capacity of his or her office and not an appointment of the Executive Director in his or her capacity as an individual.

      2.  An appointment of the Executive Director as guardian made before April 21, 1969, shall be deemed to have been an appointment in the capacity of his or her office and not in his or her capacity as an individual.
