543.545  Exemption from requirements of public bidding for construction of certain flood control facilities.  Except as otherwise provided in subsection 3, the provisions of any law requiring public bidding or otherwise imposing requirements on any public contract, project, works or improvements, including, without limitation, the provisions of chapters 332, 338 and 339 of NRS, do not apply to any contract entered into by a flood control district for the construction of a flood control facility pursuant to the master plan, if a majority of the construction costs are paid by a private developer and the written agreement:

      1.  Complies with the requirements of subsection 1 of NRS 543.360;

      2.  Clearly sets forth the computation of the construction costs, and includes the terms and conditions of the contract; and

      3.  Contains a provision stating that the requirements of NRS 338.010 to 338.090, inclusive, apply to any construction work performed pursuant to the contract.
