709.220  Undertaking by holder of franchise guaranteeing commencement of construction within 6 months from date of award of franchise.  The board of county commissioners shall, at the time of granting any franchise provided in NRS 709.210, require the applicant to enter an undertaking to the county, in a sum to be determined by the board of county commissioners, with a surety or sureties approved by the board, conditioned that such applicant shall commence active construction of the electric light, heat or power lines for which such franchise is granted within 6 months from the date of granting the same and prosecute the construction thereof to completion with due diligence; and failing to comply with the conditions of such undertaking the applicant shall forfeit all rights to the franchise.
