17:12B-196 - Applications for commissioner's approval

17:12B-196.  Applications for commissioner's approval    In all cases where the commissioner's approval is required and no procedure  for obtaining the same is specified, application therefor shall be made in  writing and the commissioner shall, within 30 days after receipt of such  application, give written notice to the State association either approving such  application, when the same may be properly disposed of ex parte, or designating  a time and place when and where the commissioner will afford, to the State  association and to any party in interest who requests it, an opportunity to be  heard.  The commissioner may grant reasonable adjournments of such hearing.   Within 30 days after such hearing, or after the date designated therefor, if  no one appears to be heard, the commissioner shall give written notice to the  State association of his determination, which notice shall state the reasons  therefor, if the application is denied.

    If the commissioner fails to give any such notice within the time prescribed  therefor, such failure shall be construed as his approval of such application.
