48:12-82.  Contributory negligence at crossings having safety gates jury question    Whenever a person is killed or injured by a locomotive or train while attempting to cross the tracks at a crossing at which the railroad company shall have assumed to establish and maintain safety gates, and such gates were not down at least half a minute before such locomotive or train crossed the highway and until it had passed by, the question whether the person so killed or injured was or was not guilty of contributory negligence shall be a question  to be determined by the jury in all actions brought to recover damages for such  loss of life or personal injury.
