5:5-70 - Holding or conducting horse race meeting contrary to or in violation of statute as misdemeanor;  disposition of fines

5:5-70.  Holding or conducting horse race meeting contrary to or in violation of statute as misdemeanor;  disposition of fines    Any person, partnership, association or corporation holding or conducting any meeting within the State of New Jersey, at which horse racing is permitted held or conducted contrary to or in violation of any of the provisions and requirements of this act, or any person or persons aiding, assisting or abetting in the holding or conducting of such meeting, shall be guilty of a misdemeanor, and upon conviction thereof shall be punished for each such offense by a fine of not less than five thousand dollars ($5,000.00) and not more than ten thousand dollars ($10,000.00), or by imprisonment in the county jail or workhouse for not more than one year, or by both such fine and imprisonment.  For the purpose of this section each day of racing in violation of the provisions of this act shall be considered as a separate and distinct offense.  All fines paid into court by any person, partnership, association or corporation found guilty of violating this section shall be transmitted and paid over by the clerk of the court to the said commission.
