76-11-15. Cancellation of registrations.

The department may cancel the registration of any brand of commercial fertilizer or soil conditioner or refuse to register any brand of commercial fertilizer or soil conditioner, upon satisfactory evidence that the registrant has used fraudulent or deceptive practices in the evasions or attempted evasions of the provisions of the New Mexico Fertilizer Act [Article 11 of Chapter 76 NMSA 1978], or any regulations promulgated thereunder; provided, that no registration shall be revoked or refused until the registrant is given an opportunity to appear for a hearing by the department.
