76-22-21. Proprietary information.
Any information obtained by the commission that is deemed by the chairman to be proprietary, technical or business information shall be held in confidence. Proprietary, technical or business information shall not be deemed a public record as set forth in Subsection C of Section 14-3-2 NMSA 1978 or be open to inspection as set forth under Section 14-2-1 NMSA 1978. The commission shall take such steps as are necessary to safeguard the confidentiality of the information.
