83 - Leases for agricultural purposes.

§ 83. Leases for agricultural purposes. 1. Any Indian who is a member of the Tonawanda nation and who resided on the Tonawanda reservation may, with the approval of the council of the nation, lease land allotted to him to any person for agricultural purposes; the term of any such lease shall not exceed one year. Any lease entered into without the approval of the council, as evidenced by the endorsements thereon of the presiding officer and the clerk of the council, shall be void and unenforceable. Any person who enters upon or occupies any of the lands of the Tonawanda reservation under a void lease may be removed as an intruder pursuant to section eight of this chapter. All crops raised under an invalid lease shall become the property of the nation, and the council of the nation may cause the crops to be harvested and sold for the benefit of the nation. Any rents received pursuant to a void lease shall also become the property of the nation, and the council shall have a cause of action to recover such rents from the person who received them. Common lands which have not been allotted to members of the nation may be leased by the council of such nation for agricultural purposes; the term of any such lease shall not exceed one year.
