382 - Optional retirement of members in the division of state police after twenty years of service.

§ 382. Optional retirement of members in the division of state police after twenty years of service. a. Any member in the division of state police in the executive department shall be entitled to retire after the completion of twenty years of total creditable service in such division, or upon attainment of age sixty in such division if prior thereto, by filing an application therefor in a manner similar to that provided in section three hundred seventy of this article. Upon so retiring such member shall receive: 1. If he elected or was required to contribute in accordance with the provisions of section three hundred eighty-one or section three hundred eighty-one-a of this article, a retirement allowance equal to the present value of a retirement allowance computed upon such period of service in accordance with the provisions of such sections, or 2. If he did not elect or was not required to contribute in accordance with the provisions of section three hundred eighty-one or section three hundred eighty-one-a of this article, a retirement allowance equal to the present value of a retirement allowance computed upon such period of service in accordance with the provisions of section three hundred seventy-five of this article. b. The provisions of this section shall be controlling notwithstanding any provision in this article to the contrary.
