§ 97-bbbb. Tattoo and body piercing regulation and permit fund. 1. There is hereby established in the joint custody of the state comptroller and the commissioner of taxation and finance a fund to be known as the "tattoo and body piercing regulation and permit fund". Such fund shall consist of all fees, penalties, fines and settlements received pursuant to article four-A of the public health law and all other monies credited or transferred thereto from any other fund or source pursuant to law. 2. Monies of the fund shall be made available to the commissioner of health for the purpose of regulating the practices of tattooing and body piercing pursuant to the provisions of article four-A of the public health law. Monies shall be paid out of the fund on the audit and warrant of the comptroller on vouchers approved and certified by the commissioner of health.
