§ 1-440.35. Sheriff's liability for care of attached property; expense of care.

§1‑440.35.  Sheriff's liability for care of attached property; expense ofcare.

The sheriff is liable for thecare and custody of personal property levied upon pursuant to an order ofattachment just as if he had seized it under execution. Upon demand of thesheriff, the plaintiff shall advance to the sheriff from time to time suchamount as may be required to provide the necessary care and to maintain thecustody of the attached property. The expense so incurred in caring for andmaintaining custody of attached property shall be taxed as part of the costs ofthe action. (1947, c. 693, s. 1.)
