§ 1‑569.5. Applicationfor judicial relief.
(a) Except as otherwiseprovided in G.S. 1‑569.28, an application for judicial relief under thisArticle shall be made by motion to the court and heard in the manner providedby law or rule of court for making and hearing motions.
(b) Unless a civilaction involving the agreement to arbitrate is pending, notice of an initialmotion to the court under this Article shall be served in the manner providedby law for the service of a summons in a civil action. Otherwise, notice of themotion shall be given in the manner prescribed by law or rule of court forserving motions in pending cases. (1927, c. 94, s. 5; 1973, c. 676, s. 1; 2003‑345,s. 2.)
