§ 104E-10.2. Conveyance of property used for radioactive material disposal.

§104E‑10.2.  Conveyance of property used for radioactive materialdisposal.

A license to dispose ofradioactive waste materials on land shall include a legal description of thedisposal site that would be sufficient as a description in an instrument of conveyance.The license to dispose of radioactive waste materials shall not be effectiveunless the owner of the disposal site files a certified copy of the license inthe register of deeds' office in the county or counties in which the site islocated. The register of deeds shall record the certified copy of the licenseand index it in the grantor index under the name of the owner of the land. Whenany such site is sold, leased, conveyed or transferred in any manner, the deedor other instrument of transfer shall contain in the description section in nosmaller type than that used in the body of the deed or instrument a statementthat the property has been used as a disposal site for radioactive wastematerials and a reference by book and page to the recordation of the license.
