§ 104E-16. Nonreverting Radiation Protection Fund. - North Carolina Statutes

§104E‑16.  Nonreverting Radiation Protection Fund.

(a)        There is herebyestablished under the control and direction of the Department a NonrevertingRadiation Protection Fund which shall be used to defray the expenses of anyproject or activity for:

(1)        Emergency responseto and decontamination of radiation accidents as provided in G.S. 104E‑9(a)(5),or

(2)        Perpetualmaintenance and custody of radioactive materials as the Department mayundertake.

In addition to any moneys thatshall be appropriated or otherwise made available to it, the Fund may bemaintained by fees, charges, or other moneys paid to or recovered by or onbehalf of the Department under the provisions of this Chapter, except for theclear proceeds of penalties. Any moneys paid to or recovered by or on behalf ofthe Department as fees, charges, or other payments authorized by this Chapter,except for the clear proceeds of penalties, shall be paid to the RadiationProtection Fund in an amount equal to the sum expended for the projects or activitiesin subdivisions (1) and (2) above.
