§ 104E-21. Conflicting laws.

§104E‑21.  Conflicting laws.

(a)        Ordinances,resolutions or regulations, now or hereafter in effect, of the governing bodyof a municipality or county or board of health relating to by‑product,source and special nuclear materials shall not be superseded by this Chapter.Provided, that such ordinances or regulations are and continue to be consistentand compatible with the provisions of this Chapter, as amended, and rules andregulations promulgated by the Commission.

(b)        It is the intent ofthe General Assembly to prescribe a uniform system for the management of low‑levelradioactive waste and to place limitations upon the exercise by all units oflocal government in North Carolina of the power to regulate the management oflow‑level radioactive waste by special, local or private acts orresolutions as provided in G.S. 143B‑216.10(b).
