§ 106‑202.20. Forfeiture of illegally possessed plants; disposition of plants.

Upon conviction of any defendant for a violation of G.S. 106‑202.19,the court, in its discretion, may order the defendant to forfeit any plant orplant parts which he possesses in violation of G.S. 106‑202.19. The courtshall direct disposition of any forfeited plant or plant part by destruction orsale. The clear proceeds of forfeitures and sales pursuant to this sectionshall be remitted to the Civil Penalty and Forfeiture Fund in accordance withG.S. 115C‑457.2. (1989, c. 508, s. 3; 1997‑261, s. 109; 1998‑215, s. 10.)
