§ 106‑399.5. Warrantless inspections.

When determined by the StateVeterinarian, in consultation with the Commissioner of Agriculture and with theapproval of the Governor, that there is an imminent threat within the State ofa contagious animal disease that has the potential for very serious and rapidspread, is of serious socioeconomic and public health consequence, or is ofmajor importance in the international trade of animals and animal products, theState Veterinarian or an authorized representative may stop and inspect withouta warrant any individual or any motor vehicle on a public or private road thatis moving:

(1)        Into the State fromany other country, to determine whether the individual or motor vehicle iscarrying any animal or any article that is capable of introducing or spreadingthe animal disease.

(2)        In interstatecommerce, upon probable cause to believe that the individual or motor vehicleis carrying any animal or any article that is capable of introducing orspreading the animal disease.

(3)        In intrastatecommerce from any other portion of the State or from any premises or areaquarantined under G.S. 106‑401, upon probable cause to believe that theindividual or motor vehicle is carrying any animal or any article that iscapable of introducing or spreading the animal disease.  (2001‑12, s. 1; 2003‑6,s. 1; 2005‑21, s. 1; 2009‑103, s. 1.)
