§ 106‑568.9. Refunds to farmers.

In the event such a referendum is carried in the affirmative and theassessment is levied and collected as herein provided and under the regulationsto be promulgated by the duly certified agencies conducting the same, anyfarmer upon whom and against whom any such assessment shall have been added andcollected under the provisions of this Article, if dissatisfied with the saidassessment, shall have the right to demand of and receive from the treasurer ofsaid North Carolina Agricultural Foundation, Inc., a refund of such amount socollected from such farmer or producer provided such demand for refund is madein writing within 30 days from the date of which said assessment is collectedfrom such farmer or producer.  Provided, that the Department of Agriculture andConsumer Services shall make tobacco poundage assessment refunds to tobaccofarmers when such demand for refund is made in writing by the tobacco farmerwithin 30 days of the close of the marketing season.
