§ 106‑65.33. Violation of Article, falsification of records, or misuse of registeredpesticide a misdemeanor.

(a)        Any person who shall be adjudged to have violated anyprovision of this Article or who falsifies any records required to be kept bythis Article or by the rules and regulations pursuant to this Article or whouses a registered pesticide in a manner inconsistent with its labeling shall beguilty of a Class 2 misdemeanor. In addition, if any person continues toviolate or further violates any provision of this Article after written noticefrom the Committee, the court may determine that each day during which theviolation continued or is repeated constitutes a separate violation subject tothe foregoing penalties.

(b)        Nothing in this Article shall be construed to require theCommittee or the Commissioner to initiate, or attempt to initiate, any criminalor administrative proceedings under this Article for a minor violation of thisArticle whenever the Committee or Commissioner determines that the publicinterest will be adequately served in the circumstances by a suitable writtennotice or warning.
