§ 108A‑39. Fraudulent misrepresentation.
(a) Any person whether provider or recipient, or personrepresenting himself as such, who willfully and knowingly and with intent todeceive makes a false statement or representation or who fails to disclose amaterial fact and as a result of making a false statement or representation orfailing to disclose a material fact obtains, for himself or another person,attempts to obtain for himself or another person, or continues to receive orenables another person to continue to receive public assistance in the amountof not more than four hundred dollars ($400.00) is guilty of a Class 1misdemeanor.
(b) Any person, whether provider or recipient, or personrepresenting himself as such who willfully and knowingly with the intent todeceive makes a false statement or representation or fails to disclose amaterial fact and as a result of making a false statement or representation orfailing to disclose a material fact, obtains for himself or another person,attempts to obtain for himself or another person, or continues to receive orenables another person to continue to receive public assistance in an amount ofmore than four hundred dollars ($400.00) is guilty of a Class I felony.
(c) As used in this section the word "person" meansperson, association, consortium, corporation, body politic, partnership, orother group, entity, or organization.
