§ 113A-38. Land acquisition. - North Carolina Statutes

§ 113A‑38.  Landacquisition.

(a)        The Department of Administration is authorized to acquirefor the Department, within the boundaries of a river or segment of river as setout in G.S. 113A‑35 on behalf of the State of North Carolina, lands infee title or a lesser interest in land, preferably "sceniceasements." Acquisition of land or interest therein may be by donation,purchase with donated or appropriated funds, exchange or otherwise.

(b)        The Department of Administration in acquiring real propertyor a property interest therein as set out in this Article shall have and  mayexercise the power of eminent domain in accordance with Article 3 of Chapter40A of the General Statutes.
