§ 116‑13.1.  Capital facilities; reports.

(a)        The General Assembly finds that although The University ofNorth Carolina is one of the State's most valuable assets, the currentfacilities of the University have been allowed to deteriorate due to decades ofneglect and have unfortunately fallen into a state of disrepair because ofinadequate attention to maintenance. It is the intent of the General Assemblyto reverse this trend and to provide a mechanism to assure that theUniversity's capital assets are adequately maintained. The General Assemblycommits to responsible stewardship of these assets to protect their value overthe years, as follows:

(1)        The Board of Governors of The University of North Carolinashall require each constituent and affiliated institution to monitor thecondition of its facilities and their needs or repair and renovation, and toassure that all necessary maintenance is carried out within funds available.

(2)        The Board of Governors shall report annually to the JointLegislative Commission on Governmental Operations and the Joint LegislativeEducation Oversight Committee on the condition of the University's capitalfacilities, the repair, renovation, and maintenance projects being undertaken,and all needs for additional funding to maintain the facilities.

(3)        It is the intent of the General Assembly to assure thatadequate oversight, funding, and accountability are continually provided sothat the capital facilities of the University are properly maintained topreserve the level of excellence the citizens of this State deserve. To thisend, the Joint Legislative Education Oversight Committee shall report to theGeneral Assembly annually its recommendations for legislative changes toimplement this policy.

(b)        Equity in University Improvements. – The Board of Governorsof The University of North Carolina shall continue to study and monitor anyinequities in funding for capital improvements and facilities needs which maystill exist on North Carolina's Public Historically Black Colleges andUniversities and North Carolina's Historically American Indian University, theUniversity of North Carolina at Pembroke, beyond the funding of the projectsprovided for in this act, and shall report annually to the Joint LegislativeCommission on Governmental Operations on any remaining inequities found,including recommendations as to how those inequities should be addressed.
